These Terms of Service (“Terms”) govern your access to and use of the YSKAIPE website (yskaipe.com), waitlist registration, platform previews, communications, and any related services (collectively, the “Services”) provided by YSKAIPE (“we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian’s permission to use the Services.
2. Accounts and Registration
To access certain features (e.g., waitlist priority, future account creation), you may need to register and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
3. Use of the Services
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates applicable law or regulation
- Attempt to interfere with, disrupt, or gain unauthorized access to the Services or our systems
- Upload, post, or transmit viruses, malware, or harmful code
- Harass, abuse, impersonate, or harm others
- Scrape, crawl, or systematically collect data from the Services without permission
- Use automated means to access the Services except as expressly permitted
- Reverse engineer, decompile, or attempt to derive source code from the Services
4. User Content
You retain ownership of any content you submit (e.g., waitlist comments, profile information, project ideas). By submitting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, display, and perform that content solely to provide, maintain, improve, and promote the Services.
You are solely responsible for your content and represent that it does not infringe any third-party rights.
5. Intellectual Property
The Services, including all text, graphics, logos, software, AI models, designs, and features, are owned by YSKAIPE or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our express written permission.
6. Third-Party Services and Integrations
The Services may include links to or integrations with third-party services (e.g., OpenAI, Slack, GitHub in the future). We are not responsible for those services or their privacy practices. Your use of third-party services is governed by their own terms.
7. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses.
8. Limitation of Liability
To the fullest extent permitted by law, YSKAIPE, its founders, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the preceding 12 months (or $100 if no payment was made).
9. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive (e.g., ownership, disclaimers, limitation of liability) will continue to apply.
10. Changes to the Terms
We may update these Terms from time to time. We will post the revised version here and update the “Last updated” date. For material changes, we may provide additional notice (e.g., email or site banner). Continued use after changes constitutes acceptance.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina. You agree to submit to the personal jurisdiction of those courts.
